Project Terms and Payment
Project Scope
All projects begin with a detailed scope of work that outlines deliverables, timelines, and costs. Any changes to the original scope may result in additional charges and timeline adjustments.
Payment Terms
- A deposit of 50% is required before work begins
- Final payment is due upon project completion
- Invoices are payable within 30 days of receipt
- Late payments may incur additional fees
Client Responsibilities
To ensure successful project completion, clients agree to:
- Provide necessary content, materials, and access in a timely manner
- Respond to requests for feedback and approval within agreed timeframes
- Ensure all provided content is original or properly licensed
- Make payments according to the agreed schedule
Intellectual Property
Client Content
Clients retain ownership of all content, trademarks, and materials provided to us. Clients grant us a license to use these materials solely for the purpose of completing the agreed services.
Developed Work
Upon full payment, clients receive ownership of the custom code and design elements created specifically for their project. We retain rights to any pre-existing code, frameworks, or proprietary methodologies used.
Warranties and Disclaimers
We warrant that our services will be performed with professional skill and care. However, we make no guarantees regarding:
- Specific search engine rankings or traffic results
- Compatibility with all future browser updates or technologies
- Uninterrupted website availability (dependent on hosting provider)
Limitation of Liability
Our liability for any claims related to our services is limited to the total amount paid by the client for the specific project. We are not liable for any indirect, incidental, or consequential damages.
Support and Maintenance
We provide a 30-day warranty period for bug fixes on delivered projects. Ongoing maintenance and support services are available under separate agreements. We recommend regular backups and updates to ensure optimal website performance.
Termination
Either party may terminate a project with written notice. In case of termination:
- Client pays for all work completed up to the termination date
- We will provide all completed work and source files upon payment
- Any deposits paid are non-refundable
Privacy and Confidentiality
We respect your privacy and maintain confidentiality of all client information. Please refer to our Privacy Policy for detailed information about how we handle your data.
Governing Law
These terms are governed by the laws of Australia. Any disputes will be resolved through binding arbitration or in the courts of Australia in accordance with Australian Consumer Law and business regulations.
